What are the possible penalties for DWI? The four possible DWI/DUI charges carry substantially different maximum penalties. The most basic charge, DWI, is no longer a violation, which is a non-criminal offense, but a class B misdemeanor and a crime; you cannot go to jail for a simple DWI conviction; on the other hand, DWI 2nd offense and aggravated DWI each carry the possibility of a year in jail. If you are charged with felony aggravated DWI based on serious bodily injury (including to yourself), you can face up to seven years in prison; a fourth-offense DWI is also a felony. |
